Florida provides both expungement and record sealing to individuals who want to remove their records from public views. If you received deferred adjudication, were found innocent at trial, or charges were dropped before trial, you may be eligible to have your record sealed or expunged. If you pled guilty or were convicted of a misdemeanor or felony, and the court did not withold adjudication, then you are not eligible for expungement or record sealing.
Under Florida law, an arrest record can be expunged so that the record of your arrest is closed to the public. An expungement in Florida destroys your arrest record so that the public and any government agency cannot see your record. Read more
If you were arrested and the court withheld adjudication or you were acquitted after going to trial, you may be eligible for record sealing. A record sealing seals your criminal record from public view and allows you to honestly answer that you have not been convicted of a crime. Read more
If you were convicted, you are not eligible to have your Florida record expunged or sealed. You may, however, be eligible to have your conviction vacated. A conviction in Florida can be vacated where it has been less than two years since the conviction and there is some ground to support the request.
