New Jersey allows for the expungement of certain offenses. Once the case is expunged then the information will no longer appear, except in limited circumstances, and will not show on background checks.

Expungement Eligibility


New Jersey allows for the expungement of indictable offenses (felonies) depending on the crime. Certain crimes may not be expunged (generally these include sex crimes, murder, manslaughter, arson, crimes against children, robbery, sale of hard drugs, and other crimes).

Indictable offenses are similar to what other states classify as felony convictions.

In order to expunge an indictable offense conviction the following requirements must be met:

  • 10 years have passed since completion of probation, incarceration and payment of fines (whichever is latest)
  • No pending charges are against you
  • Must not be convicted of another crime in New Jersey or another state (okay if the other conviction and the case you want expunged constituted a single event)
  • Cannot have 3 or more disorderly or petty disorderly violations against you
  • Must not have ever been granted dismissal of charges through pre-trial intervention (does not include disorderly or petty disorderly offenses)
  • Must not have had any criminal offense expunged in New Jersey or another state

However, motor vehicle offenses, including DUIs, are not eligible for expungement. Once the arrest and case are expunged then the information will no longer appear, except in limited circumstances, and will not show on background checks. Do I have to disclose it ever?
