In New Jersey, if you were arrested and not convicted, it is possible to have your arrest and case record expunged, thus making it as if you were never arrested for the offense. If you were not convicted and the charges were dismissed or if you completed Pre-Trial Diversion (PTI) or another diversion program and six months have passed since the charges were dismissed, then you may be eligible for an expungement. Once the arrest and case are expunged, the information will no longer be accessible, except in limited circumstances, and it will not show on background checks.

Additionally, if you were convicted of a crime you may be eligible to expunge the conviction. Municipal ordinance violations, petty disorderly persons violations and disorderly persons violations are similar to what other states classify as misdemeanor convictions. Indictable offenses are similar to what other states classify as felony convictions.

Expungement New Jersey Requirements

In order to expunge a municipal ordinance violation the following requirements must be met:

  • 2 years must have passed since you completed probation, incarceration, or payment of all fines (whichever is latest)
  • No pending charges against you
  • Must not be convicted of a crime (indictable offense or felony in New Jersey or any other state
  • Cannot have 3 or more disorderly or petty disorderly persons violations

The following requirements must be met in order to expunge a disorderly persons violation:

  • 5 years have passed since completion of probation, incarceration and payment of fines (whichever is latest)
  • No pending charges against you
  • Must not be convicted of a crime (indictable offense or felony) in New Jersey or another state
  • Cannot have more than three disorderly or petty disorderly violations against you (including the conviction you are seeking to have expunged.)
  • Must not have ever been granted dismissal of charges through pretrial intervention (does not include disorderly or petty disorderly offenses)
  • Must not have had any criminal conviction expunged in New Jersey or another state

In order to expunge an indictable offense conviction the following requirements must be met:

  • 10 years must have passed since completion of probation, incarceration, and payment of fines (whichever is latest)
  • No pending charges against you
  • Must not be convicted of another crime in New Jersey or any other state (except if the other conviction and the case you want expunged constituted a single event)
  • Cannot have 3 or more disorderly or petty disorderly violations against you
  • Must not have ever been granted dismissal of charges through pretrial intervention (does not include disorderly or petty disorderly offenses)
  • Must not have had any criminal offense expunged in New Jersey or another state

Certain crimes are not eligible to be expunged (generally these include sex crimes, murder, manslaughter, arson, crimes against children, robbery, sale of hard drugs, and other crimes). Also, motor vehicle offenses in New Jersey, including DUIs, are not eligible for expungement. Once the case is expunged, then the information will no longer appear, except in limited circumstances, and it will not show on background checks.
