Under Utah law, you can apply to have your conviction reduced by up to two degrees in class. By having your conviction reduced by even one degree the waiting period for expungement can be reduced, thus making you eligible for expungement much sooner. Additionally, if you are convicted of a felony we recommend reducing it to a misdemeanor even if it was expunged, because licensing agencies are able to see expunged records. This may make you eligible for licenses that you would otherwise be ineligible for and will increase your chances of being granted a license.
Reduction of a felony to a misdemeanor can also restore your right to possess a firearm. In order to have your offense reduced you must have been sentenced to probation and completed your probation sentence. Additionally, if your offense requires that you register as a sex offender then you must complete the registration requirements and the registration must have expired before you can file to have the conviction reduced.
The typical case in Utah takes about 3 to 4 months. The courts operate on a first-come, first-served basis, so the sooner you start, the sooner your record is cleared.
