Reduction of Certain Felonies to Misdemeanors - OR Law

Oregon Revised Statutes Section 161.705 allows for those convicted of certain felonies to have those felonies reduced to a Class A misdemeanor. The types of felonies that can be reduced are:

  • Any Class C felony
  • Class B felony for unlawful delivery of Marijuana for consideration (ORS 475.860)
  • Class A felony for racketeering activity (ORS 166.720)

In order to eligible for reduction, you must be convicted of one of the above felonies and must have successfully completed a sentence of probation. The court will consider your character and the nature and circumstances of the offense. Based upon these considerations, the court will decided if it believes felony treatment would be too harsh.

Alternatively, according to Oregon Revised Statutes Section 161.585, a felony conviction can be reduced if you were sentenced to imprisonment prior to November 1, 1989 for a crime punishable as either a felony or misdemeanor.
