In order to expunge a possession of a controlled substance case the person must have completed a deferred prosecution program pursuant to Minnesota Statute section 152.18. Once a person is discharged and the proceedings are dismissed the case record is eligible to be expunged. The expungement will seal the arrest and court records so no one can see it.
