Criminal "Expungement" in Minnesota is the process of going to court to ask a Judge to seal a criminal record. When a record is sealed, it does not show up in a criminal background check of the courts records. If you can show that you have made real changes in your life, that you are a different person now, and that it is very unlikely that you will not commit another crime, the court may expunge your conviction. It is important to note that even when the court grants an expungement of a conviction in MN, records that are kept by some agencies, including the BCA (Bureau of Criminal Apprehension), might not be expunged. The case can take several months (typically four to five) because the court has to give the government an opportunity to respond, and if the government objects a hearing is usually held. The length of each petition varies based on the circumstances of each case and each individual, as well as the case load of the court at the time.
