Converting a Felony Conviction to a Misdemeanor Conviction - Indiana Law

If you are convicted and sentenced for a Class D felony, you may qualify to have your felony converted into a Class A Misdemeanor. Pursuant to Indiana Code Section 35-50-2-7 to qualify for the reduction, you must meet several requirements:

  • Must not be a registered sex or violent offender
  • Not be convicted of a Class D felony that resulted in the bodily injury of another
  • Must not be convicted of perjury or official misconduct
  • Three years must have passed since the completion of your sentence and the satisfaction of any other obligations imposed by the sentence
  • Could not have been convicted of a felony since completing your sentence or other obligations
  • No criminal charges can be pending against you

Once a conviction is reduced from a Class D felony to a Class A misdemeanor, you may truthfully state that you have not been convicted of that felony.

It is also important to note, that if you have had your Class D felony reduced to a Class A misdemeanor and you are convicted of a felony within 5 years, the prosecutor can petition the court to have your conviction converted back into a felony.
