New Legislation Provides Pennsylvania Conviction Sealing

The new law, formerly Senate Bill 166, was signed by Governor Tom Wolf on February 16, 2016 and goes into effect on November 14, 2016. Under the new statute, 18 Pa.C.S. 9122.1, those convicted of certain misdemeanors may petition the court for an order of "limited access," more commonly known as a record sealing. Prior to the new law, the only way to clear a misdemeanor conviction in Pennsylvania was to receive a pardon, be over the age of 70, or be dead for three years. The new law will benefit those Pennsylvania citizens who are seeking to clear their records so they can capitalize on educational opportunities, obtain jobs, and pursue other endeavors they were previously unable to pursue due to their criminal history.

Pennsylvania Conviction Sealing - Eligibility

If you are convicted in Pennsylvania, a conviction record is available for the public to view. If you obtain a Pennsylvania Sealing, those records will be removed so the public can no longer access them. You are eligible to seal a case if you have been free from arrest or prosecution for 10 years following your conviction or final release from confinement or supervision, whichever is later. This relief is only available for second-degree and third degree misdemeanors and ungraded offenses with a maximum penalty of two years.

You also cannot have ever been convicted of an offense punishable by imprisonment of more than two years (includes felonies and certain misdemeanors), four or more offenses punishable by imprisonment of one or more years, simple assault under section 2701(unless it is a third degree misdemeanor), sexual intercourse with an animal under section 3129, impersonating a public servant under section 4912, intimidating of witnesses or victims under section 4952, retaliating against a witness or victim under section 4953, intimidating/retaliation or obstruction of justice in a child abuse case under section 4958, or any case which requires sex offender registration.
