
Washington has different types of record sealing procedures available for different types of records. Generally criminal records are made available in two places, the court where the record was created and/or the Washington State Patrol (WSP). Because court records are extremely difficult to seal, Higbee & Associates does not offer this service and that procedure will not be discussed. However, sealing records at the Washington State Patrol is something we do offer and we have a high level of success in such matters.
It is important to know that even though dismissed cases do not appear on online WSP criminal history searches, the arrest and dismissed cases will show on WSP searches that use fingerprints. The main benefits of sealing the Washington State Patrol Records are as follows:
It will keep the record from appearing on employment or housing background checks, which mostly use the Washington State Patrol Report.
Records sealed at the Washington State Patrol also get removed from the Federal Bureau of Identification's (FBI) database (NCIC). This can make international travel easier and reduce delays when purchasing a firearm.
Makes getting many professional licenses less complicated.
To be eligible, you must either have had a case that was dismissed with no conviction data or participated in a deferred prosecution or pre-prosecution diversion program (it is important to note that deferred sentencing programs or other types of diversion programs are not eligible).
ELIGIBILITY FOR STRAIGHT DISMISSAL WITH NO DEFERRED OR DIVERSION PROGRAM
If the case was a dismissal without deferred prosecution, you have no prior convictions of a felony or gross misdemeanor, and you have not been arrested since this case, then the Washington State Patrol and arresting agencies cannot deny the request to seal the record. If you were arrested for a different crime or charged with another crime between the time of the case you are trying to seal and now then the WSP has the discretion to not seal the case. Also, if you were convicted of a felony or gross misdemeanor before the case you are trying to seal then the WSP has the discretion not to seal the case.
ELIGIBILITY FOR DISMISSAL AFTER DEFERRED PROSECUTION OR PRE-PROSECUTION DIVERSION
If you received deferred prosecution or pre-prosecution diversion and the case was later dismissed, the WSP has the discretion of whether to seal and delete the records. Since the criminal justice agency has the discretion whether they wish to seal and destroy the records, it is important to show that you deserve to have it deleted and why the agency should do so.
