Oregon Criminal Record Expungement

Oregon law uses the term "set aside" when it refers to what is most commonly called expungement. We use the terms interchangeably. Expunging or setting aside an Oregan criminal record will allow you to say you have not been convicted of the crime.

The quickest and easiest way to find out if your record is eligible to be expunged or set aside is to take our free online eligibility test.

How To Expunge A Conviction

Oregon law, Oregon Revised Statutes Section 137.225, allows a person to clear most misdemeanor and felony convictions so they can state they are not convicted of the crime. On January 1, 2022, Oregon enacted SB 397 which allows you to file for an expungement after an established amount of time from the conviction. The amount of time in which you must wait is determined by the level of offense you are trying to expunge. The new waiting periods are as follows:

  • Class B felonies - 7 years
  • Class C felonies - 5 years
  • Class A misdemeanors - 3 years
  • Class B or C misdemeanors or contempt of court - 1 year

In most circumstances, the waiting period begins either at the date of conviction or release from imprisonment, whichever is later. If you have another subsequent case after the waiting period, you’ll have to wait the time period again before you can file for expungement of the case.

Previously, applicants were required to wait 3 years for all offenses and also have no other offenses for the 10 years prior to filing for expungement. These long and confusing periods made it difficult to file for expungement and for former offenders to change their lives. Additionally, it is no longer required that financial obligations related to the case be paid before filing for expungement. Furthermore, the court may no longer charge a filing fee for expungement petitions, making it accessible to more citizens. SB 397 is a welcome change to all those attempting to clear up their Oregon criminal history.

Expungement of Oregon Arrests

Oregon statutes allow a person to clear most arrests and dismissed court cases so they can state they were not arrested and do not have a court case on their record. If no charges were filed in court, you must wait 60 days from the date of arrest or from when the prosecuting attorney declines the case. If you have no other convictions on your record, you can file immediately following a dismissal or acquittal. If you do have other convictions, you will need to be conviction-free for the same periods as conviction expungement, the length depending on the level of offense you seek to clear prior to filing the expungement petition.

We start the same day you sign up. Having handled more than 23,000 cases, we know how to get records cleared as fast as possible. The time it takes varies by court, but the typical case in Oregon takes between four to six months. The courts operate on a first-come, first-served basis, so the sooner you start, the sooner your record is cleared.

"How easy was that! Well at least for me. I am mad that I waited so long to do this. Just did a background check on myself and that felony is G-O-N-E. You guys are the best." Richard H. - Portland, OR
