I am an extremely satisfied client. Paul William Hecht and his staff went above and beyond what can be expected for their reasonable fee. My case was tougher than average and they were straight-forward with me before any fees were paid. Thanks to their incredibly hard work, and despite opposition from the DA, they achieved the results I hoped for. I will be forever grateful and feel like the weight of the world is off my shoulders. There truly are no words to adequately express just how thankful and pleased I am.

Facts about San Diego County

San Diego District Attorney - Background Information

Penal Code 1203.4 requires that anyone seeking an expungement must serve a copy of the request to expunge a record on the prosecuting attorney, in most cases that is the District attorney. If it is not the district attorney, it is usually a city attorney.

Bonnie M. Dumanis is the 2014 District Attorney for San Diego County, a position for which she took office in 2003 and has been reelected for three terms. Before taking office, Bonnie attended the Thomas Jefferson School of Law where she earned her law degree in 1976. After attending law school, Bonnie served as a Clerk Typist and a Superior Court Judge. Bonnie has had a number of jobs that inform the way in which she leads the San Diego County District Attorney's office. In fact, Bonnie keeps a plaque in her office that was awarded to her during her first job in the District Attorney's office that reads, "the clerk helping in your division today may be your boss tomorrow."

Under Bonnie's guidance as the District Attorney, laws have been reformed through initiatives co-written by and passed by the District Attorney's office including:

  • California's Proposition 83, Jessica's Law: this law tightens restrictions on child molesters and sexually violent predators.
  • Proposition 69, Chelsea's Law: this law fought to increase the use of DNA to solve crimes.
  • Senate Bill 618: a prisoner reform program that provides non-violent offenders with job training, treatment, and wrap around service to keep them from returning to a life of crime once they are released from prison.

Many of the judges require a court hearing for an expungement. If there is a hearing, the District Attorney will have the opportunity to object or argue against the judge expunging the record. The most common reason DA's object to expungement is for violations of the terms of probation. Often times, even the slightest violation can cause a DA to object to the expungement.

San Diego County is the 5th most populated county in the United States with a population of 3,095,313 people. The city of San Diego is the second most populated city in California and serves as the county seat. This means that the county will get a large number of expungement applications per year and their system can get backed up. You need to complete your expungement forms correctly the first time or be faced with the possibility of long wait times before your new application will be viewed. San Diego was one of the first counties of California when the state was acquired as part of the United States in 1850. San Diego is home to many research facilities, such as the Salk Institute for Biological Studies. Additionally, the city houses the San Diego Zoo, Sea World, and has a longstanding relationship with the United States Navy. San Diego’s crime rate is generally lower than the other large cities with 38 murders per 100,000 people a year. Real estate in San Diego is expensive with a median listing of $454,900.00 and an average of $688,723.00, whereas the median household income is $60,797, according to city-data.com.

San Diego County is a large coastal and boarder metropolis that offers many career opportunities whether working as a peace officer, as a member of the United States Armed Forces, as a member of the private sector, or as a worker for the city. Regardless of where you choose to seek employment, it is imperative to have a clear criminal record. Due to San Diego's proximity to the boarder, background checks are run with great frequency. Inability to pass criminal background checks for employment may make it difficult to secure a career in the field of your choosing. In particular, if you wish to become a member of the local military or of the armed forces, then you must be able to possess a firearm, which is a right that is deprived to you when you have certain criminal convictions. If you have a criminal record in San Diego County and would like to start a career, expunging or sealing your offense from your criminal record is your best option.
