Conviction Expungement

Expunging your Missouri conviction, through Missouri Revised Statute § 610.140, from your record is important if you want to be able to pass background checks for jobs, promotions, housing, international travel, or even volunteering at your child's school. Missouri Revised Statute § 610.140 allows for expungement of most felonies and misdemeanors. In order to qualify for expungement, there are certain criteria that must be met (Mo. Rev. Stat. §610.140(5)). The most important criteria to meet is the waiting period. For felony convictions, there is a 3-year waiting period. For misdemeanors this drops to a 1-year waiting period while for first-time alcohol-related misdemeanors (DUIs) the waiting period increases to 10 years. During the waiting period, you cannot be found guilty of any other offense besides traffic violations and you also cannot have any pending charges or fines/restitution.

Only one felony and two misdemeanors may be expunged in Missouri in a person’s lifetime, regardless of which court the expungement is sought in.

Not all offenses are eligible for expungement. The following offenses are not eligible per Mo. Rev. Stat. §610.140(2):

  • Any Class A felony
  • Any offense that requires registration as a sex offender
  • Any felony assault
  • Any domestic assault
  • Any felony kidnapping
  • Any ordinance violation equivalent to an ineligible offense
  • Any motor vehicle offense or violation when the individual has a Commercial Driver's License (CDL)

Benefits of Expungement

Approved expungements will result in closed records. When a record is closed, access to the records is not available to the public, but will still be available to criminal justice agencies, and some other public agencies for licences and employment screenings. Closed records can be opened by the court if there is good cause, but, from our experience, this hardly ever happens.

Expunged records will not affect employment except for positions in banks, insurers, or other positions that are required by law to exclude applicants with certain convictions.

Closed records will still be available to a number of public entities that use background checks to screen applicants for licenses, private security, and care of children, persons with disabilities, and the elderly, as well as other employment in sensitive areas.

Closed records will still be available to law enforcement agencies for the purpose of issuing firearm purchase and possession permits. Mo. Rev. Stat. §610.120.

If the prosecution does not rebut the presumption, then the court will order an expungement.
