In order to vacate a felony conviction you must meet the required waiting period depending on the level and type of offense. The waiting period is two-pronged. You must wait a certain amount of time after your conviction that begins upon the release from community custody, release from full or partial confinement, or the sentencing date, whichever is later. You must also be conviction-free for the same amount of time prior to your application to the Court.

The felony offense waiting periods are:

  • Class B Felony: 10 Years
  • Class C Felony: 5 Years
  • Class A Felonies, sex offenses, and felony DWI offenses are not eligible to be vacated

Another requirement is that you have obtained a Certificate of Discharge from the court. Once you complete all the requirements of your sentence, including paying any and all legal financial obligations, the Court is required to issue you a Certificate of Discharge. However, sometimes the Court fails to issue the Certificate and sometimes the completion of all the requirements occurs after supervision or custody has ended causing the Certificate to not be issued. Therefore, if you already completed your sentence, including paying all fines and court costs, you should petition for a Certificate.

A Certificate of discharge not only potentially allows you to vacate your conviction, but also restores your other civil rights (not including firearm rights). Neither a Certificate of Discharge or vacate of your felony conviction restores firearm rights in Washington. However, it is required that you obtain a Certificate in order to be eligible to restore your firearm rights.
