Jeffrey B. Jackson, Esq.<\/a>, an Indiana based attorney with the Law Firm of Higbee & Associates, which runs RecordGone.com, spoke with John Kesler of WIBC Radio, regarding the effects of the new criminal record expungement law on restoration of firearms rights, on August 19, 2013.<\/p>\n

Positive Changes With To Indiana Firearm Restoration Law<\/h3>\n

Indiana\u2019s new criminal record expungement law, IC 35-38-9<\/a>, (also know as a \u201cSecond Chance Law\u201d), was implemented on July 1, 2013 and extends the availability of expungements and record sealing to thousands arrested and\/or convicted of a felony or misdemeanor in Indiana. Record clearing will not only provide thousands of former offenders the chance to become an active participant in society, but, in addition, the new law will allow those who are granted expungements and record clearing the opportunity to petition for the restoration of all rights, including the right to restore firearms.<\/p>\n

According to Jackson, \u201cthe big issue (is) the fact that a felon can get his (or her) gun back if the offense is expunged (provided federal law permits it).\u201d The passing of this law is great news for Hoosiers with former convictions. Once a person\u2019s record is expunged, he or she will be able to petition for the restoration of firearm rights. <\/p>\n

Overwhelming Response From The Public<\/h3>\n

During the broadcast, Jackson answered incoming calls. All twenty lines available to WIBC were full, which is the most calls for a guest on the program since the election last year. Jackson attributes the popularity of the broadcast to Hoosier\u2019s passion for owning firearms noting that for some people in Indiana, \u201cbeing able to get their guns back is almost as important as breathing.\u201d<\/p>\n
