Expunging Adjudication of Delinquency – MN Law

Minnesota Statute Section 260B.198, Subdivision 6 says that the court may expunge the adjudication of delinquency at any time that it deems advisable. Even though the juvenile records are automatically sealed, Minnesota law does not automatically "expunge" juvenile records unless you petition the court for an order expunging them.

Fortunately, Minnesota law gives a court the power to expunge your juvenile records. If you were prosecuted as an adult for a particular crime, the records will be kept longer and will be open to public inspection like any adult matter. Fortunately, Minnesota Statutes Section 609A.02, Subdivision 2 does allow juveniles who were prosecuted as adults to eventually apply for expungement as well. A petition for expungement must be filed in the court where you were adjudicated/convicted. By having your records expunged you can state that you are not convicted or adjudicated delinquent.
