The state of Washington allows the court to vacate certain non-violent misdemeanor convictions. Once vacated (expunged), the case is no longer deemed a conviction. State law gives you the right to state to anyone, including prospective employers, that you were NOT convicted of that offense, after a vacate motion has been granted.

Once a conviction is vacated (expunged), the fact that you have been convicted of the offense will not be included in your criminal history for purposes of determining a sentence in any subsequent conviction. For all purposes, including responding to questions on employment or housing applications, a person whose conviction has been vacated may state that he or she has never been convicted of that crime.

How long does the process take?

Do I have to disclose it ever?

Can I become a schoolteacher, nurse, or other occupation?

Will it still show up on my background check?

No. Once your conviction has been vacated, Washington law treats it as though it never occurred because a conviction that has been vacated may not be disclosed by an agency to any person, except a criminal justice agency. The general public, including potential employers and landlords, will not have any access to the records.
