Utah allows for the expungement of convictions. Getting a Utah arrest or conviction record expunged is the process of sealing a criminal case after the case has been resolved. Having the conviction expunged opens the door to applying for potential job opportunities without the worry of a potential employer turning you down on account of old criminal records. Only limited agencies are able to view an expunged record, and an expungement will make a record unavailable to the general public.

How To Expunge A Criminal Record In Utah

Expungement in Utah is a multistep process that is put forth by Utah law. The process requires interaction with the Utah Bureau of Criminal Identification (BCI), the prosecutor (which is usually the district attorney or city attorney) and the court. The victim of the offense also may be notified by the prosecutor and given an opportunity to object.

One of the requirements for Utah expungement is that you complete the waiting period. In some cases, we can reduce the classification of the offense and thereby reduce the waiting period. The waiting period begins to run at the time you complete probation or the time that parole is completed. The waiting periods are:

  • Capital felony; Felony 1; Forcible felony 2; any sexual offense against a minor Never
  • 2nd and 3rd degree felonies 7 Years
  • Class A misdemeanor 5 years
  • Class B misdemeanor 4 years
  • Class C misdemeanor 3 years
  • Alcohol related traffic offenses (Title 41) 10 Years
  • Dismissed Cases - Immediately (as long as 30 days have passed since arrest)
  • Plea in Abeyance - Immediately following dismissal after completion of term

It is important to keep in mind that often times we can reduce the classification of the offense by two degrees (eg, reduce a Class A misdemeanor to a Class C misdemeanor) and thereby reduce the waiting period.

In addition to meeting the waiting period for the case, you also cannot have a certain number of separate criminal episodes. You cannot have:

  • 5 or more convictions, of any degree (felony or misdemeanor)
  • 3 misdemeanor Bs if you have 4 or more convictions
  • 2 misdemeanor As is you have 3 or more convictions
  • 2 or more felony convictions

However, if at least 10 years have elapsed from the completion of your last sentence, then each is conviction limit is increased by one to:

  • 6 or more convictions, of any degree (felony or misdemeanor)
  • 4 misdemeanor B's if you have 5 or more convictions
  • 3 misdemeanor A's is you have 4 or more convictions
  • 3 or more felony convictions

If you fit into any of the situations listed above then you may be able to reduce some of the offenses and thus become eligible for Utah expungement. For instance, if you have too many felony convictions, then we can possibly reduce one of them so that you will be eligible.

Plea in Abeyance Expungement in UT

A plea in abeyance is when you plead "guilty" or "no contest" to the charges and the plea is held in abeyance for up to one year. If you complete the conditions of the plea in abeyance agreement, the charges will be dismissed after the abeyance period and there will be no conviction on your record. If 30 days have passed since the arrest and the charges have been dismissed or dropped, then you can expunge the case.
