Who can see my record if it is sealed?
If your record is sealed it is unable to be viewed or pulled up by anyone except the court. The court will only open your record if you are convicted of a crime later and they need the information for sentencing.
Your conviction will be sealed and you can additionally add up to three misdemeanors to be sealed, provided they meet the eligibility standards.
If I meet the eligibility requirements am I guaranteed to have my convictions sealed?
No, unfortunately the standard used by the court is discretionary. This leaves the decision of whether or not to seal your record up to the judge. However, should you meet all of the requirements it would be highly unlikely for the motion to be denied.
What if I am formally charged with another crime after I have my record sealed?
If you are formally charged with another crime your sealed record become immediately unsealed and will remain unsealed. It will only become sealed again if the charges are terminated in favor of you.
