
Under New York Criminal Procedure S 160.58, an individual convicted of most felony drug, marijuana, or Willard non-drug eligible crimes may request to have their records for those crimes sealed if they successfully complete DIVERSION, DTAP, or a similar substance abuse treatment program recognized by the court. This sealing will also extend to up to three of the client’s misdemeanor drug or marijuana convictions.
Additionally, an individual may request that a court seal records of and destroy fingerprints, palm-prints, photographs, proofs and copies thereof when the outcome of the criminal case is favorable to the defendant. A favorable finding means acquittal, outright dismissal, or upon dismissal after an adjournment in contemplation of dismissal pursuant to CPL 170.55/170.56.
