
Michigan allows a person to set aside one juvenile offense. If the court sets aside a juvenile offense then the adjudication is deemed to have never occurred (with a few small exceptions). Setting aside means that the adjudication will be sealed from inspection by the public. Various law enforcement/criminal justice agencies will continue to have access to the records; however, they may only use it under narrow circumstances.
A person is eligible to set aside a juvenile offense if he or she is 24 years of age or older and if at least 5 years have passed since the adjudication was imposed or since his or her release from detention (if detention was imposed). Certain offenses are ineligible, including:
Each person can only have one juvenile offense set aside. If the person has had an adult felony conviction, or has had multiple juvenile offenses, he is not eligible to set aside any juvenile offenses.
