Michigan Setting Aside Juvenile Offense Michigan Compiled Law § 712A.18e

Michigan allows a person to set aside one juvenile offense. If the court sets aside a juvenile offense then the adjudication is deemed to have never occurred (with a few small exceptions). Setting aside means that the adjudication will be sealed from inspection by the public. Various law enforcement/criminal justice agencies will continue to have access to the records; however, they may only use it under narrow circumstances.

A person is eligible to set aside a juvenile offense if he or she is 24 years of age or older and if at least 5 years have passed since the adjudication was imposed or since his or her release from detention (if detention was imposed). Certain offenses are ineligible, including:

• Offenses that if committed by an adult could result in life imprisonment;
• A “specified” juvenile offense (where the juvenile was prosecuted as an adult); and
• A traffic offense

Each person can only have one juvenile offense set aside. If the person has had an adult felony conviction, or has had multiple juvenile offenses, he is not eligible to set aside any juvenile offenses. Furthermore, there is a 5-year waiting period, or the person must have reached 24 years of age (whichever comes later). Take the free online eligibly test to see if you are eligible.
