Expungement of Juvenile Records- PA Law

Pennsylvania Consolidated Statutes Annotated Section 9123 allows for you to petition the court to have your juvenile records expunged for most offenses. The court will order the expungement of your records if it finds any of the following circumstances:

  • A complaint was filed that was not substantiated or was dismissed by court
  • A written allegation was filed but not approved for prosecution
  • 6 months have elapsed since you successfully completed an informal adjustment or consent decree with no adjudication or conviction pending
  • You are at least 18 years old and 6 months have passed since you satisfied all terms and conditions following a conviction for most summary offenses (minor crimes mostly violations of the Motor Vehicle Code)
  • 5 years have passed since your final discharge from commitment, placement, probation or any other disposition with no further charges pending.

If you are not eligible to have your juvenile records expunged from the above circumstances, you can still file a petition for expungement if you are 18 or older and the prosecutor has agreed to the expungement. In this situation the court will consider many factors in determining whether to grant your petition to expunge your juvenile records. The court will consider:

  • The type of offense
  • Your age
  • History of employment
  • Criminal activity
  • Drug or alcohol problems
  • Adverse consequences that you may suffer if the records are not expunged
  • If the retention of the record is required for the protection of public safety
