Arizona Revised Statute 13-901E provides that the trial court may terminate the period of probation and discharge the defendant if the ends of justice will be served by this and the conduct of the defendant warrants it. Once terminated, you are relieved of the duties imposed by probation and you can immediately file to have your conviction set aside and dismissed.
In order to be eligible you must pay all fines and attend all classes ordered by the court before the court will modify your probation. The court considers various factors, such as the need for relief, the seriousness of the offense, the criminal history, and the potential benefit to society. We handle all aspects of the case for you so that you do not have to appear in court in most cases.
Having your probation terminated will allow you to state that you are not serving a sentence for a crime. You will then become eligible for setting aside the conviction so you will no longer be convicted of the crime.
The typical case in Arizona takes about 3 to 4 months.
