Arizona law allows for the destruction of juvenile records in certain circumstances so that you do not have to disclose the juvenile records and it is as though it never occurred. Juvenile records are not automatically sealed and/or destroyed so you must petition the court to do so.

Arizona law allows for the destruction of juvenile records. If the records are destroyed then the incident is treated as if it never happened and it will not appear on a background check.

In order to destroy your Arizona Juvenile conviction, you must meet the following requirements:

  • Be at least 18 years old
  • Not convicted of a felony as an adult
  • Not adjudicated delinquent for the following offenses:
    • Murder (1st or 2nd Degree)
    • Forcible Sexual Assault
    • Armed Robbery
    • Violent Felony Offenses
    • Chronic Felony Offender
    • Class 1 Felony
    • Class 2 Felony
    • Class 3 Felony for preparatory offenses, arson, robbery, or organized crime, fraud
      and terrorism
    • Class 3, 4, 5, or 6 Felony involving a dangerous offense
    • DUI
  • No pending charges
  • Completed all terms and conditions of your court ordered probation or received a discharge from the Arizona Department of Juvenile Corrections
  • Paid all fines and restitution
  • It is in the interest of justice to have your records destroyed

If you were adjudicated delinquent of one of the above offenses, you may still have your juvenile records destroyed if:

  • You are at least 25
  • You have not been convicted of a felony as an adult
  • There are no pending charges
  • Completed all terms and conditions of your court ordered probation or received a discharge from the Arizona Department of Juvenile Corrections
  • You paid all fines and restitution
  • It is in the interest of justice to have your records destroyed

How long does the process take?

Typically, the case takes about four to five months.

What if I want to become a police officer?

For Arizona, once your juvenile records have been destroyed, it is treated as though it never occurred, and you can deny it on any application, including an application to become a police officer. Thus, it is highly unlikely that anyone would know about it.

What if I join the military?

If you want to join the US military, then it becomes a matter of federal law, not Arizona state law. All branches of the military will want to know about your juvenile offenses, even if they have been expunged. There is still a risk of being discharged from the military if you don’t tell them and they later find out about it. It’s always advisable to disclose that you had a conviction, but it was taken before a judge and he deemed it in the interest of justice to expunge/seal the record from public view.

Will it still show up on my background check?

No. Once the court grants the order, they must destroy the juvenile court and department of juvenile correction records.
