California Penal Code section 4582 allows people who were convicted of felonies or people convicted of a misdemeanors that require registration as a sex offender pursuant to Penal Code section 290 to apply for a certificate of rehabilitation.
Although a certificate of rehabilitation will not erase the conviction, it will put something very positive on your record. If you have to register as a sex offender, it may terminate the registration requirement. Additionally, a certificate may increase your chances for being issued a professional or occupational license.
With more than 80 percent of employers conducting background checks, a certificate of rehabilitation is a great investment.
This is an excellent option for (1) those who are not eligible for expungement because their sentence involved state prison, (2) those who had their felony expunged and want an additional level of relief, or (3) those who are required to register as a sex-offender.
To be eligible, you must meet waiting periods that start from the sooner of the time you were discharged from jail or prison or the time you completed probation. You must also have resided in California for the past 5 years.
