Texas makes it difficult to escape a criminal arrest record. If your case was dismissed or you successfully completed deferred adjudication, you may be able to seal or expunge records of that case, but unfortunately Texas law does not provide for the expungement of actual convictions, regardless of how much time has passed, unless you have obtained a pardon for that case. If you were arrested, but not convicted, you may be eligible for expungement. Even arrests that did not end up in a conviction can cost a person jobs and housing opportunities decades later.

Simply put, a Texas criminal record can be a virtual ball and chain. It can follow you around well after you were arrested, by showing up in background checks and ruining your chances of gaining better employment and other opportunities. Fortunately, Texas law provides that many people with criminal arrest records in Texas are able to have their record expunged.

If your criminal record is causing you hardship or embarrassment and your charges were dismissed or you received deferred adjudication, we would love to help expunge or seal it so that you can go on with your life without the fear, anxiety or shame that results when someone does a background check on you.

We are one of the leading expungement law firms in the country and we can clear your record even further after the process is concluded in the courtroom. We can have your expunged record removed from some of the most used background check companies. If these private background check companies do not receive proper notification that the record has been expunged, it can remain in their system for months or years and could be erroneously reported to a potential landlord or employer during that time.

Lay the foundation for a better life by taking this free online evaluation to find out about your TX record clearing eligibility.

Are You Eligible for Expungement

The law in Texas only allows for you to expunge your arrest if it did not result in a conviction or community supervision. Class C misdemeanors that resulted in the successful completion of deferred adjudication are also eligible for expungement. If you are unsure if you received deferred adjudication, we highly recommend that you call the court where your case was handled. However, we would be glad to do that preliminary research for you for a fee of $200. We would apply that $200 to any service that you are eligible for.

If you were convicted of the offense, you are not eligible for expungement. This includes any case where you were found guilty, pled guilty or pled no contest, unless you received deferred adjudication for a class C misdemeanor. If you received deferred adjudication for an offense other than a class C misdemeanor, you may be able to get your record sealed through an Order of Non-Disclosure. If you receive a pardon for your conviction, you may get an expungement. We do not handle pardon cases in Texas and cannot answer questions about them. You can get free information about pardons at Pardon411.com.

Benefits of a Texas Expungement

Expungement will keep your records out of public view. The release, dissemination or use of expunged records by any agency is prohibited "for any purpose." You can deny the arrest and the existence of the expunction order unless being questioned under oath in court— including when applying for government and law enforcement jobs.

Having your record expunged in Texas can be life changing. Expungement can clean up your criminal record, and a clean criminal record can be the difference between getting a job or promotion and not. The same is true with housing. Even dating and social media web sites are integrating background checks.

Having a clean criminal record has never been more important. It is no longer just about employers and landlords. Friends, neighbors and coworkers can conduct background checks on you without you ever even knowing. Your ability to travel abroad can be impacted by a criminal record. The list of potential problems can go on and on.
